When expedited review may be available
USCIS may consider severe financial loss to a person or company, emergencies or urgent humanitarian circumstances, qualifying nonprofit interests, government interests, and clear agency error. Each category has conditions, and the decision is discretionary.
A need for an employment authorization document, standing alone, does not necessarily establish an expedite basis. Potential financial losses must be documented and connected to compelling circumstances. Urgency caused by failing to file on time or respond promptly generally does not carry the same weight as circumstances outside the applicant’s control.
Build the request around evidence
Begin with a short chronology: what happened, when action is needed, and what will happen without it. Then identify the records that support those facts. Depending on the reason, useful evidence may include medical documentation, an employer’s detailed letter, financial records, or documents showing a government interest.
Avoid unsupported claims that a situation is an emergency. Explain why the requested immigration action addresses the problem. A medical letter should describe the relevant urgency; an employer letter should identify the actual operational or financial consequences rather than simply praise the employee.
The request and the underlying case are separate
The appropriate request channel depends on the form, account access, and stage of processing. USCIS may ask for evidence after an initial inquiry. Keep the request number, submission, and any response so the record is clear if further action becomes necessary.
Expedited handling does not waive eligibility, required checks, or a response deadline. A granted request does not guarantee approval of the underlying application. Continue monitoring ordinary notices and maintaining any available status or work authorization; the request itself provides neither.
Compare the available options
Premium processing is a separate paid service for specified filings. Its availability can limit the discretionary expedite route, subject to agency exceptions. A case inquiry, congressional inquiry, ombudsman request, or federal lawsuit all serve different purposes and have different requirements.
Moro Legal can review the pending filing, the claimed urgency, and the evidence to determine whether an expedite request is a sensible next step. Share your receipt notice, prior correspondence with immigration agencies, the relevant deadline, and documents explaining the harm with our office prior to the consultation. If the case is already at the National Visa Center or a consulate, different procedures will apply.
