Understand the published emergency standard
The State Department describes an expedite route when an immigrant visa is available and the case involves a life-or-death medical emergency. This is not simply the same checklist USCIS uses for its own expedite requests. Ordinary separation or inconvenience does not automatically meet the published NVC standard.
Identify where the case is pending before requesting action. A petition still awaiting USCIS approval, a case being processed at NVC, and a case already transferred to a consulate involve different offices. Sending the request to the wrong stage can waste time when the circumstances are urgent.
Prepare a focused medical record
The published procedure calls for a scanned letter or statement from a physician or medical facility explaining the emergency and providing contact information. The request should identify the case and the people involved so NVC can connect the evidence to the correct file.
The supporting explanation should make the timing and consequences understandable. Describe the relevant relationship, the action requested, and how faster processing relates to the medical situation. Use accurate records and appropriate translations, and avoid burying the central issue in an unrelated account of the entire family history.
Request review without overlooking the remaining steps
NVC’s published email channel is NVCExpedite@state.gov. Follow the current official instructions for identifying information and attachments. The consular post’s acceptance and instructions determine how an approved request proceeds.
Even if approved, an expedited case does not waive admissibility, the medical examination, security checks, or interview requirements. When a case is already at a post, follow the individual post’s inquiry procedure.
Visa availability and realistic expectations
An expedite cannot create an immigrant visa number. A family preference or employment-based case may still face a waiting list even when the personal circumstances are compelling. Approval of the underlying petition and availability of a visa are separate questions.
Moro Legal can review the case stage, medical documentation, and proposed request. Provide our office with the NVC case number, copies of the approval and welcome notices, recent correspondence, and the relevant medical necessity letter. A consultation can also address whether the issue belongs with USCIS, NVC, or the consulate, and what to prepare while awaiting a response.
