VAWA Petitions for Victims of Domestic Abuse

A qualifying survivor of abuse can obtain permanent residence without the abuser’s cooperation. Consider eligibility, evidence, and a safe way to communicate.

Who may qualify?

VAWA provides self-petition routes for certain abused spouses and children of U.S. citizens or permanent residents, and certain abused parents of adult U.S. citizens. VAWA stands for “Violence Against Women Act” but these protections are not limited to women – many men are qualifying victims of domestic abuse. The qualifying relationship and the immigration status of the abuser matter.

Eligibility requires evidence of battery or extreme cruelty, shared residence, good moral character, and other statutory requirements. A spousal case generally must also establish a good-faith marriage. Divorce, the timing of events, and changes in the relative’s status can affect eligibility and must be carefully reviewed before proceeding with a petition. A VAWA petition may take the place of a pending marriage-based I-130 immigrant petition, particularly in cases with a pending adjustment of status application where an abusive spouse withdraws or threatens to withdraw cooperation, allowing for eventual green card approval.

Documenting the relationship and abuse

The evidence should explain what happened in the individual’s situation. A personal declaration from the petitioner is required. The declaration may be supported by additional evidence including records of communications, medical or counseling records, witness accounts, court documents, police reports, photos, or other credible materials.

A vague statement about relationship problems does not establish battery or extreme cruelty. The petition should distinguish ordinary conflict from the conduct relevant to the legal standard. Examples of conduct that may constitute abuse include any physical harm, threats to have the spouse deported, economic and financial control, social isolation, destroying property, surveillance, spying, intimidation, psychological abuse, or verbal abuse. In some cases, there may be little or no documentation of the abuse besides the petitioner’s declaration. The law explicitly recognizes the petitioner’s own declaration is still valid evidence and may be sufficient to approve a VAWA petition.

Independent filing and safe contact

The filing of a VAWA petition does not require the abuser to sign or support the petition in any way. Protected information and mailing procedures are important. Arrange a safe mailing address for correspondence or have official case correspondence sent to your attorney’s office. Arrange for safe and reliable contact methods before submitting documents or scheduling communications with an attorney.

Do not place a detailed abuse narrative in an ordinary website inquiry or shared email account. During a consultation, the firm can arrange an appropriate way to provide sensitive records.

The petition and later immigration benefits

The filing or approval of a VAWA petition is not the same as receiving a green card. Adjustment eligibility, visa availability (if applicable), admissibility, and employment authorization require separate analysis. A prima facie determination is not final petition approval and does not itself grant permanent residence.

Moro Legal can assess the VAWA claim and other potential immigration filings for victims of abuse and crimes. An I-751 abuse waiver, U visa, or T visa will involve different requirements and evidence. In cases where the abuser is not a U.S. citizen or permanent resident, it is important to screen for U visa or T visa eligibility.

Common questions

Before you file.

Does my abusive spouse have to be involved if I file a VAWA petition?

A VAWA self-petition does not require the abuser’s cooperation. VAWA regulations require protection of petitioner information from disclosure to an alleged abuser.

Can men apply under VAWA?

Yes. The immigration protections are available to qualifying applicants regardless of gender. Sometimes men feel social pressure not to admit they have been victims of abuse, but it is important to share all relevant details during a consultation to evaluate potential VAWA eligibility.

Is VAWA the same as an I-751 abuse waiver?

No. I-751 concerns removal of conditions for someone who already holds a conditional green card. A VAWA petition qualifies an immigrant to apply for a green card.

We cannot say enough good things about our experience with our attorney Joseph. From the very beginning, he was professional, knowledgeable, responsive, and incredibly reassuring throughout what was an extremely stressful immigration process. Our case was particularly challenging given the current immigration climate and the fact that we are from a country subject to restrictions. To our amazement, our entire adjustment of status process was successfully completed in just **six months**, and we were approved for our Green Card. Achieving this result in the current administration and under circumstances that could have easily made the process much more complicated is something we truly believe speaks to our attorney’s exceptional knowledge and dedication. He never made us feel like just another case number. He took the time to explain things clearly, answer our questions, address our concerns, and make sure we understood what was happening at every stage. His professionalism and commitment gave us so much peace of mind during a very uncertain time. We are incredibly grateful for his hard work and for the successful outcome of our case. If you are looking for an immigration attorney who is knowledgeable, trustworthy, strategic, and genuinely committed to his clients, we wholeheartedly recommend him. Thank you for helping us achieve such an incredible milestone in our lives!

He helped us with any questions we had and when it came time for the interview everything was all in place and made it super easy for the USCIS official to approve our case. Very thankful to have been paired with Joseph's law firm through my husband's insurance. He and his team went above and beyond to answer our questions. Thank you!

If I can give more than 5 stars , I certainly would do so . Working with Joseph was outstanding, bringing my now wife to the US from Colombia . We started with the K1 visa application and now she has her green card after we got approved at the interview at USCIS. Our case was particularly challenging as she was studying in another country at the time of filing the I-129F . Once that was approved, we had to transfer the case to the Colombian embassy and there was a big delay in the process for scheduling the interview. However , Joseph handled this case with the upmost professionalism and gave us guidance on everything from start to finish. To sum up , if you ever want to bring a foreign fiancé to the US , it’s a lot of paperwork and screening. You definitely need expert legal professionals by your side during the whole process. Joseph can be your go to for every step of the way . We are forever grateful for this service!
