Affirmative Asylum Applications with USCIS

An asylum application should explain what happened, why it happened, and why you need protection. A complete, consistent filing record is especially important under current USCIS referral policies.

The basis for an affirmative asylum claim

Asylum generally requires either past persecution or a well-founded fear of future persecution connected to race, religion, nationality, political opinion, or membership in a particular social group. The relationship between the harm and a protected ground is central. Economic hardship or general insecurity alone do not constitute persecution.

Affirmative applications are generally filed with USCIS by people within its jurisdiction. Prior removal proceedings, entry history, previous applications, and statutory bars can affect where and whether a case may proceed. The general one-year filing deadline has limited exceptions that require their own facts and evidence.

Prepare the record before filing

A useful declaration gives a clear chronology and explains events in the applicant’s own experience. Supporting materials may include identity documents, medical records, messages, witness statements, and reliable reports on country conditions. The evidence should connect general conditions to the individual claim.

Review prior visa applications, statements at the border, and earlier filings for consistency. Explain genuine errors, contradictions, or missing records rather than ignoring them. Translations must be accurate and certified by the translator. An applicant should not submit a borrowed story or add details merely because they appear in another successful case.

Referral without an asylum interview

A rule effective July 28, 2026, permits USCIS to refer certain affirmative asylum applications to immigration court without first conducting an interview. An August 31, 2026, correction accompanies the rule. USCIS estimated in the original Federal Register rule announcement that it may refer approximately 31% (around one in three) of affirmative asylum applications to immigration court without an interview with USCIS.

Referral is different from a direct USCIS grant or denial of asylum, for which the rule preserves an interview. Applicants should not assume they will always have an interview to supply missing facts. The possibility of referral makes careful initial preparation and an understanding of the next procedural stage particularly important.

The firm’s role and the next steps

Moro Legal handles affirmative asylum applications before USCIS. The firm does not represent clients in removal proceedings in immigration court. If USCIS refers a case to immigration court, separate legal counsel will be required for that stage. That possibility should be discussed before filing.

Prior to your attorney consultation, prepare a timeline of relevant events for your asylum claim, any prior immigration applications, and available evidence for your case. Work authorization, travel, and family members require separate analysis. Merely filing an asylum application does not immediately authorize employment. The consultation can identify deadlines, jurisdiction, and the documents needed to make an asylum claim.

Common questions

Before you file.

Does referral mean USCIS has finally denied my asylum claim?

A referral sends the matter into immigration court proceedings, which are handled by a different government agency. It is procedurally different from a direct USCIS denial. The court stage requires separate legal representation.

Can I apply after one year?

An exception may be available for qualifying changed or extraordinary circumstances, with additional timing requirements. It must be evaluated individually.

Will every applicant receive an asylum interview?

No. Current regulations permit certain referrals without an interview. A complete filing should not depend on a guaranteed later opportunity to supplement the account orally.

We cannot say enough good things about our experience with our attorney Joseph. From the very beginning, he was professional, knowledgeable, responsive, and incredibly reassuring throughout what was an extremely stressful immigration process. Our case was particularly challenging given the current immigration climate and the fact that we are from a country subject to restrictions. To our amazement, our entire adjustment of status process was successfully completed in just **six months**, and we were approved for our Green Card. Achieving this result in the current administration and under circumstances that could have easily made the process much more complicated is something we truly believe speaks to our attorney’s exceptional knowledge and dedication. He never made us feel like just another case number. He took the time to explain things clearly, answer our questions, address our concerns, and make sure we understood what was happening at every stage. His professionalism and commitment gave us so much peace of mind during a very uncertain time. We are incredibly grateful for his hard work and for the successful outcome of our case. If you are looking for an immigration attorney who is knowledgeable, trustworthy, strategic, and genuinely committed to his clients, we wholeheartedly recommend him. Thank you for helping us achieve such an incredible milestone in our lives!

If I can give more than 5 stars , I certainly would do so . Working with Joseph was outstanding, bringing my now wife to the US from Colombia . We started with the K1 visa application and now she has her green card after we got approved at the interview at USCIS. Our case was particularly challenging as she was studying in another country at the time of filing the I-129F . Once that was approved, we had to transfer the case to the Colombian embassy and there was a big delay in the process for scheduling the interview. However , Joseph handled this case with the upmost professionalism and gave us guidance on everything from start to finish. To sum up , if you ever want to bring a foreign fiancé to the US , it’s a lot of paperwork and screening. You definitely need expert legal professionals by your side during the whole process. Joseph can be your go to for every step of the way . We are forever grateful for this service!
