O-1A and O-1B use different standards
O-1A applies to extraordinary ability in the sciences, education, business, or athletics. O-1B covers extraordinary ability in the arts or extraordinary achievement in motion pictures and television. The correct standard depends on the work being performed.
An “extraordinary ability” visa does not require being a celebrity in the everyday sense. The petition must explain the field, the significance of the accomplishments, and the relationship between the applicant’s record and the applicant’s proposed work in the United States.
Evidence that explains the accomplishments
Potential evidence includes awards, published material, significant contributions, judging, leading or critical roles, scholarly work, commercial success, or remuneration, depending on the category. The applicable criteria and any comparable evidence provisions must be matched to the case.
A recommendation letter that simply calls someone talented adds less than a detailed explanation supported by records. Useful documents demonstrate the scale, selectivity, impact, or recognition of an achievement.
The U.S. work must be documented
A U.S. employer or qualifying agent generally files Form I-129. The petition needs the applicable consultation, agreement or terms of employment, and a description of the events or activities. An itinerary and agency documentation may be required for work involving multiple employers or locations.
The O-1 visa is not an unrestricted freelance work permit. The approved petition must support the actual engagements. A new employer or material change can require another filing. Entrepreneurs should examine the petitioner’s legal structure and the proposed relationship carefully rather than assuming they can file a personal petition.
Family, support personnel, and future plans
Qualifying spouses and unmarried children under 21 may seek O-3 status, which does not authorize employment. Certain essential assistants may qualify for O-2 in eligible artistic, athletic, motion picture, or television cases; O-2 is not a general support category for every O-1 field.
Moro Legal can review O-1 visa requirements, select the most relevant evidence, and plan the petition around the actual engagement dates. A possible future EB-1A or EB-2 petition should be evaluated separately. Temporary O-1 approval does not establish eligibility for permanent residence – while they appear similar on the surface, EB-1A requirements have substantial legal differences from the O-1 qualifications.
